Terms and Conditions

 

FOR A CONTINUING PROFESSIONAL DEVELOPMENT SERVICE

 

1 - Designation

PRACTYS CONSEIL SARL is a professional training organization whose head office is located at 3 Rue De Genève - BP 50367 - Cedex 06 - 69451 LYON,
registered under SIREN number 419325378 with the Prefect of the Lyon region, NDA 84 69 21254 69.

 

2 - Purpose and scope of application

The present General Sales Conditions determine the conditions applicable to training services provided by PRACTYS CONSEIL on behalf of a customer. Any training order placed with the company implies the customer's unreserved acceptance of these General Terms and Conditions of Sale. These conditions prevail over any other customer document, in particular over any general conditions of purchase.

 

3 - Training agreement, quotation and certificate

For each training course, PRACTYS CONSEIL undertakes to provide the customer with a training agreement, and beforehand, at the customer's express request, with an estimate. The customer must return to the company a completed, dated, signed and stamped copy of this/these document(s), with the specific mention "Bon pour accord" on the estimate. At the customer's request, a certificate of attendance or completion of training can be provided.

 

4 - Prices and payment terms

Training prices are quoted in euros, exclusive of tax, and include VAT at the current rate. Daily rates start at €1,900 excluding VAT. This rate is indicative and may vary according to the way in which the training is carried out, your specific needs and your situation. Our training courses are always tailor-made.
Payment is due on receipt of invoice, in cash. Invoices can be paid by bank transfer or cheque.

 

5 - Payment by an OPCO

If the customer is eligible for funding from an OPCO, it is the customer's responsibility to apply for funding before the start of the service, and to inform PRACTYS CONSEIL when the training agreement is signed.

Subrogation of payment is only possible for intra-company training and if the OPCO has agreed to cover the costs:

- must be received by PRACTYS CONSEIL at least 15 days before the event;

- covers the full cost of the service (training fees + mission expenses)

If this is not the case, the customer will be invoiced for the full cost of the training.

 

6 - Postponement and cancellation conditions

Requests to postpone or cancel all or part of a training course must be made in writing to the training organization. PRACTYS CONSEIL will invoice the services provided in full or in part and the related costs, as well as any sums actually spent or incurred for the execution of the postponed or cancelled training course. Where applicable, PRACTYS CONSEIL will reimburse the CLIENT for any sums unduly paid (article L.6354-1 of the French Labor Code).

Notwithstanding the foregoing, the CLIENT also undertakes to pay the following sums by way of compensation:

For in-company training :

- Up to 90 days before the start of the course: 30% of cancelled services.

- Between 89 and 30 days before the start of the course: 50% of cancelled services.

- Less than 29 days before training: 80% of services cancelled.

For inter-company training courses organized on behalf of a network or franchise :

- According to the compensation conditions agreed with the network head or the company and mentioned in the training agreement.

Sums paid as compensation cannot be charged to continuing professional training funds, nor can they be reimbursed by an OPCO. They will be invoiced separately.

In the event of non-performance of its obligations due to a fortuitous event or force majeure, PRACTYS CONSEIL may not be held liable to its customers. The latter will be informed by e-mail.

 

7 - Training program

If necessary, PRACTYS CONSEIL's trainers may modify training content to suit the dynamics of the group or the level of participants. The program content shown on the presentation sheets is therefore provided for information purposes only.

 

8 - Intellectual property and copyright

Training materials, whatever their form (paper, digital, electronic, etc.), are protected by intellectual property and copyright. They may not be reproduced, in whole or in part, without the express agreement of the company. The customer undertakes not to use, transmit or reproduce all or part of these documents with a view to organizing or running training courses.

 

9 - Accessibility

We are attentive to the needs of people with disabilities. When you register, please let us know of any special requirements so that we can assess their feasibility. Our training rooms are designed for easy access and use by people with reduced mobility.
We systematically adapt the content of our training courses to your disability wherever possible.

 

10 - Information technology and civil liberties

The personal information communicated by the customer to PRACTYS CONSEIL is used to process the registration and to create a customer file for commercial prospecting. In accordance with the French Data Protection Act of January 6, 1978, customers have the right to access, rectify and object to any personal data concerning them.

 

11 - Applicable law and jurisdiction

These General Terms and Conditions of Sale are governed by French law. In the event of a dispute between PRACTYS CONSEIL and the customer, an amicable solution will be sought. Failing this, the matter will be referred to the competent court.
